Terms and conditions of the jet ski rental contract
1th - TENANT
For all purposes of this contract, the driver of the jet ski, signatory of this contract, is considered as the lessee and responsible for the jet ski, regardless of who has booked and/or paid for the rental of the jet ski.
2th - LESSOR
The lessor is considered to be Doña. GLORIA PAREJO TORRES with DNI 02256342L and address at Avenida del Mar Menor N8, Mar de Cristal, Cartagena 30384 (Murcia).
3th - Alquiler - Duración
Rental periods are 1 hour, 4 hours, full day (8 hours), or Monday to Friday (check availability). The opening hours are from 10:00 to 19:00.
4th - PAYMENT
The lessee shall pay the lessor the stipulated amount for the rental, petrol costs are to be paid by the lessee. and must return the vehicle with the SAME deposit as at the time of rental. Likewise, an amount of 200€ is established as a security deposit, which the lessee shall pay in the event that upon return of the aforementioned jet ski, the lessee should return the vehicle with the SAME deposit as at the time of rental.
In the event that the lessee fails to comply with the payment obligation, the lessor may unilaterally terminate the contract by notifying the lessee without prior notice. The lessee shall be entitled to claim from the lessor the costs and interest arising from the claim for non-payment without prior notice, and shall be entitled to claim from the lessee the costs and interest arising from the claim for non-payment.
5th - DELIVERY
The lessor shall deliver the jet ski to the lessee in perfect mechanical condition, and shall check the external elements in the presence of the lessee in order to find any scratches or dents that the jet ski may have. These will be marked on the delivery note and cannot be claimed from the hirer on return. The hirer accepts responsibility for any other damage to the jet ski at the time of return, whether this has occurred while driving or during parking. At the handover, the hirer will explain the operation of the jet ski and will answer the hirer's questions about its operation. The lessee affirms that he/she has fully understood the lessor's explanations and understands the operation of the jet ski.
6th - RETURN
The lessee shall return the jet ski together with the accessories (key, waistcoats, lines, etc.) on the date and time indicated by the lessor at the same address where it was delivered, in the same conditions in which it was received, except for the normal wear and tear of the correct use of the jet ski.
7th - DRIVER's CONDITIONS
The lessee, as the driver of the jet ski, affirms to be of the age required by the lessor to drive the rented jet ski, as well as to have sufficient experience to drive it. In this respect, he/she declares to have a valid Spanish driving licence to drive this jet ski, only the following will be considered as valid driving licences in Spain:
- Those issued in accordance with current Spanish legislation
- Those issued by the Member States of the European Union
- Those issued internationally by third countries that are recognized in Spain. recognized in Spain
8th - MISUSE OF THE JET SKI
Any action that contravenes traffic regulations, the specifications of the jet ski manufacturer and the lessor's instructions shall be considered misuse of the jet ski. Abnormal wear and tear, ascertained by the lessor, of the mechanical parts of the jet ski, especially tyres, will be considered as misuse of the jet ski and will be charged to the lessee.
9th - TRAFFIC AREA
The hirer undertakes not to drive the jet ski outside the boundaries of the Region of Murcia.
10th - DRIVER'S DUTIES
The lessee, driver of the jet ski, undertakes to comply with all laws, regulations, ordinances or rules on navigation, of the Spanish administrations, and especially the specific regulations relating to the use and driving of the jet ski. Likewise, the lessee undertakes to monitor the levels of oil, hydraulic fluids and coolant as indicated by the lessor, and to inform the lessor of any mechanical anomaly as soon as it is detected. Failure to monitor these aspects could lead to serious breakdowns or wear and tear which will be at the lessee's expense if he fails to comply with his obligation.
The lessee may not carry out any type of intervention, modification, manipulation, repair or replacement of any part or accessory of the jet ski without the express prior approval of the lessor, non-compliance by the lessee will result in the lessee paying the costs of reconditioning the jet ski to its original state and paying an amount as compensation for immobilisation of the jet ski. The lessee undertakes to keep the jet ski with the safety locks provided by the lessor as long as the jet ski is unattended by the lessee. Particularly important is the warning given by the lessor in this act to refuel only with unleaded petrol.
11th - IN THE EVENT OF AN ACCIDENT
If the lessee is involved in any kind of accident or claim, he/she shall immediately notify the lessor. The lessee understands that the jet ski will not be replaced and the contract will be automatically cancelled without the lessee being entitled to any refund or compensation, except in situations where the cause of the accident is due to the fault of another vessel or through no fault of the lessee's own, as recognised in the corresponding report from the competent authority.
12th - JET SKI DAMAGES
The lessee undertakes to cover with the deposit deposited any type of damage that may occur to the jet ski during the rental period, both in circulation and in parking. The lessor may retain the part of the deposit that he deems appropriate to cover the repair. Once the repair has been completed, he will present the corresponding invoice to the lessee, settling the remaining part of the deposit, if any. In the event that the repair is greater than the deposit, the lessee will cover the remainder, in which case the lessee will be solely responsible, and the lessor may take any legal, civil or criminal action he deems appropriate.
13th - LOSS OR THEFT OF THE JET SKI
As in the case of an accident, in the event of theft or total or partial loss of the jet ski, the lessee undertakes to immediately notify the lessor of this fact and to cooperate fully with the lessor and the insurance company in the investigation and defence of any investigation or proceedings. If the jet ski is stolen or lost due to the lessee's negligence, the lessee shall be liable, and shall pay the lessor the market value, according to the tables of the Ministry of Finance, without this implying a waiver on the part of the lessor to execute the civil and/or criminal legal actions it deems appropriate against the lessee. The rental contract will be considered cancelled, without the lessee being entitled to any reimbursement. In the event of theft of any of the accessories or parts of the jet ski, the lessee shall be responsible for the theft and shall compensate the lessor for the official price of the manufacturer of the stolen part or accessory plus the cost of labour invoiced by the corresponding workshop.
14th - DAMAGE TO OCCUPANTS AND THEIR PROPERTY
The lessee and his occupant exempt the lessor from all liability for any damage they may suffer, both physical and material, arising from the normal or abnormal use of the rented jet ski.
15th - COSTS
Expenses arising from fuel, breakdowns, repairs, etc., shall be borne by the lessee, provided that these have been caused by the use of the jet ski, due to its use.
16th - PENALTIES AND OTHER CHARGES
The lessee undertakes to pay all fines for any infringement of current and applicable legislation, especially those relating to the navigation code and regulations that are imposed on him, as well as the costs arising from the removal of the jet ski, by the agents of the authority. In the event of fines requiring the identification of the driver, the lessor shall notify the competent authorities exclusively of the identity of the lessee.
17th - KEY LOSS
The loss of the keys of the jet ski will be charged on the deposit deposited by the hirer in the amount of the COST OF THE KEY FROM THE MANUFACTURER PLUS ONE HUNDRED EUROS, for the expenses incurred by the hirer.
COURTS' TERRITORIAL JURISDICTION
For any litigation arising between the parties from the interpretation or fulfilment of this contract, the parties, expressly waiving any other jurisdiction that may correspond to them, will submit to the Courts and Tribunals of Cartagena.
